Dean Giroir along with his three lawyers are going after the New Orleans Public Belt Railroad Co. They are hoping to be awarded payment that will help ease the victim’s suffering, medical expenses, lost earnings, and loss of enjoyment of life.

Giroir was unable to walk for three weeks after a piece of steel suddenly cut through his leg while he was operating a sledgehammer. The metal then lodged under his skin, where a staph infection grew.

The Railroad Co. is alleged to have violated the Federal Employer’s Liability Act in failing to provide proper tools, equipment, assistance, and a safe work environment.  

With the help of his lawyers, Joseph P. Miller, Benjamin Saunders, and Carisa German-Oden of Davis Saunders in Mandeville, Giroir will fight to be awarded due to the injury he sustained.

The judge presiding over the case will be U.S. District Judge Kurt D. Engelhardt.

According to the state Office of Miners’ Health Safety and Training, on Jan. 27 John C. Lester Jr. was the first in the year 2011 to be killed as an on the job miner.

Lester had been working for the mine for a little over three months and was an apprentice miner. Although he didn’t require constant supervision he did need some. According to police, the young man had been dead for three hours before someone found him.

The young miner fell onto a conveyer belt and asphyxiated after being covered under a pile of coal.

Authorities are still investigating the fatal accident.

Walter Cassiday was working on ceiling lighting at Midstate Manufacturing in Galesburg when he made a wrong step and fell through.

According to the other employees, Cassiday struck some metal with his face before hitting the ground.

Medical crews rushed him to a nearby hospital, where he was unable to survive his severe facial injuries.

Police are continuing to investigate.

The 30-year-old victim was working at the Setton Pistachio plant on a pistachio auger when the incident occurred. An auger is a machine that separates the nuts from their shells.

While performing maintenance on the machine another worker turned it on. According to a Cal-OSHA spokeswoman, the machine was not locked and should have been while the maintenance was being done. 

Tulare police along with Cal-OSHA are continuing to investigate the fatal accident.

The identity of the victim has not yet been released.

Steven Rasey had just made a delivery to an Iowa farm when his semi became immobilized. He then attempted to use a skid loader to free the truck and got caught between the two.

Medical crews arrived on the scene, where Rasey was unconscious. They then rushed him to Buchanan County Health Center in Independence, where he was unable to survive.

Rasey had been employed by Wisconsin Plastic Drain Tile.

The victim, 24-year-old Inocencio Morales-Chalma, was suddenly run over by a large and heavy vehicle known as a “grove goat.”

Police reported that he was killed immediately in the accident, which they have ruled an industrial death.

Charlotte County Authorities are continuing to investigate into the fatal mishap.

Zach Fitzilliam, 34, was working on an oil rig site when a chunk of metal came crashing down on his from 39 feet up above.

Police are emergency crews arrived on the scene and airlifted the worker to University Medical Center in Lubbock, where he was last reported to be in critical condition.

According to county officials, Fitzilliam had a hard hat on at the time of the accident.

Authorities are continuing to look into the case.

The 26-year-old man was killed when a wall fell on him and the other victims while they were pouring cement.

Medial crews rushed the injured to a nearby hospital. The three surviving workers were reported to be in serious condition.
