Dean Giroir along with his three lawyers are going after the New Orleans Public Belt Railroad Co. They are hoping to be awarded payment that will help ease the victim’s suffering, medical expenses, lost earnings, and loss of enjoyment of life.

Giroir was unable to walk for three weeks after a piece of steel suddenly cut through his leg while he was operating a sledgehammer. The metal then lodged under his skin, where a staph infection grew.

The Railroad Co. is alleged to have violated the Federal Employer’s Liability Act in failing to provide proper tools, equipment, assistance, and a safe work environment.  

With the help of his lawyers, Joseph P. Miller, Benjamin Saunders, and Carisa German-Oden of Davis Saunders in Mandeville, Giroir will fight to be awarded due to the injury he sustained.

The judge presiding over the case will be U.S. District Judge Kurt D. Engelhardt.

The 30-year-old victim was working at the Setton Pistachio plant on a pistachio auger when the incident occurred. An auger is a machine that separates the nuts from their shells.

While performing maintenance on the machine another worker turned it on. According to a Cal-OSHA spokeswoman, the machine was not locked and should have been while the maintenance was being done. 

Tulare police along with Cal-OSHA are continuing to investigate the fatal accident.

The identity of the victim has not yet been released.

The victim, 24-year-old Inocencio Morales-Chalma, was suddenly run over by a large and heavy vehicle known as a “grove goat.”

Police reported that he was killed immediately in the accident, which they have ruled an industrial death.

Charlotte County Authorities are continuing to investigate into the fatal mishap.

William Abts was working in a Fountain City building and cutting into a steel bar on the building. Part of it toppled over and he was buried under concrete.  

Abts was rushed to a nearby community hospital, but was later pronounced dead. He could not survive the injuries he sustained in the accident.

Wisconsin police are continuing to investigate the fatal incident.

The U.S. Mine Safety and Health Administration, along with the Elko police and their bomb squad, are continuing to search for the two Meikle mine workers.

About 300 employees were present at the time of the 1:15 a.m. accident.

It is believed that a large amount of pressure on a hoist caused the disaster.

The underground operations were immediately shut down and families were notified.

Barrick Gold Corp. have undergone 11 fatal accidents in the past 11 years.

Information on the present situation in regards to the men being alive does not look encouraging.

Morgan Gainer was on a job site in a residential area when he suffered the fatal blow.

Medical crews arrived on the scene, where Gainer was pronounced as dead.

Authorities, along with the Maryland Occupational Safety & Health Administration, are conducting a full investigation into the fatal accident.Foul play is not thought to have been involved.

Gainer worked for a company based out of Elkridge, Maryland, called W.F. Wilson & Sons Inc.

Medical crews along with police and fire officials rushed to the scene where John Fugate was fatally injured.

Authorities are continuing to investigate the incident. A scheduled autopsy today has hope to lend further details.

Employees were sent home and the plant shut down for the rest of the day.

Fugate was an employee at Maryland Bootz Industries plant for over 20 years.

Police responded to a scene in Claremont, where 34-year-old Leo Gonyea was underneath enormous paper rolls.

Gonyea was immediately transported to a local hospital, where he was later pronounced dead.

There were no witnesses at the scene when Gonyea was pulled into the machine.

Police and the Occupational Safety and Health Administration are investigating the fatal incident.

William Wilson, 39, was working at Appleton Paper, located at 1030 West Alex-Bell Road along Interstate 75, when a spreader bar that was hanging from a forklift fell onto him, trapping him underneath around 10:45 a.m.

Emergency responders had to use a crane to lift the bar off him. Wilson was taken to Miami Valley Hospital where he was later pronounced dead.

The accident is under investigation.
